Planning Commission

The duty of the Commission is to review proposed amendments to the Zoning Ordinance (including requests for re-zoning) and plans for proposed developments or subdivisions and advise the Town Council regarding such proposals.  The Commission cannot re-zone property:  the power and authority to re-zone property lies with, and only with, the Town Council.

All requests for rezoning must be submitted to the Planning Commission in accordance with the requirements of the Zoning Ordinance of the Town of Collinsville and in accordance with the rules of the Planning Commission.

The Planning Commission meets at 7:00 p.m. on the second Monday of each month at the Town Hall.

Building Permits and Inspection

The Town of Collinsville requires that building permits be obtained in accordance with the provisions of the building and other technical codes adopted by the Town Council and currently in effect.  These codes include, but may not be limited to:

Upon approval of your Permit Application, you will be required to pay a fee which is determined according to the cost of your project.  This fee only partially covers the cost of administration and inspection.  The balance of administrative and inspection cost is covered by other revenues and is considered a sound investment by insuring the use of appropriate construction methods and materials on projects within the Town.

During the course of any construction, several inspections may be required.  These inspections are not intended to encumber the progress of your project, but are a means of insuring that your builder is complying with building code and other requirements to make your finished project all that you expect.  Although it is the project owner's responsibility to request the required inspections on a timely basis, many owners choose to delegate that responsibility to their contractor.  Upon request, inspection reports will be provided to the property owner free of charge.

Zoning

On October 19, 1987, the Town of Collinsville adopted Ordinance No. 87-04 entitled the Zoning Ordinance of the Town of Collinsville which regulates the use of lands and structures within the Corporate Limits.  This regulation was adopted with the intent of preserving the overall character of the Town while providing for compatible growth and development.

Questions about zoning regulation should be directed to the Zoning Administrator by calling 524-4215 or 524-2135.  While many questions can be answered immediately, some require research and may require a return call.  All questions will be answered ~ most answers will also be provided by letter.

Zoning Board of Adjustment

The Zoning Board of Adjustment performs three functions: 1) To hear and decide appeals from enforcement of the Zoning Ordinance; 2) to consider and grant or deny variance requests; and, 3) to hear and grant or deny requests for special exceptions.  

The Zoning Board of Adjustment is a 5 member board which will conduct a public hearing and consider the request of the applicant.  The Board has three (3) options when acting upon an application: 1) grant the request or reverse the determination of the Administrative Officer; 2) deny the request or deny reversal of Administrative action; or, 3) table the application for consideration at a later date.  The Board may also find that it is not empowered to act on a particular application and may refer the applicant to the proper agency or authority.  And, if granting a request, the Board may impose other conditions or provisions which must be complied with.

The Zoning Board of Adjustment is NOT a legislative body with authority to substitute its opinion for that of the Town Council nor is it charged with the routine administration of the Zoning Ordinance.  The Board does not have unlimited power.  It must comply with the powers granted to it by state statute and local ordinance.  All decisions of the Board must be based on certain guidelines which are included in the Zoning Ordinance of the Town of Collinsville (Ordinance 87-04) and the Code of Alabama of 1975.

Your Zoning Board of Adjustment Application must be complete.  An application is not considered complete unless all required documentation is provided at the time of submission.  An incomplete application may not be accepted by the Board.  

Applications for Administrative Appeal must be filed within fifteen (15) of the action from which appeal is taken.  Written notice of such appeal must specify grounds for the appeal and should include any supporting information.

For Special Exception and Variance, a complete application, including supplemental information, must be submitted to the Zoning Board of Adjustment, at least twenty-one (21) days prior to the meeting at which the Board is to hear the request.  By meeting this requirement, an applicant is not guaranteed that a request will be heard and acted upon at a particular meeting.

Prior to any Public Hearing, the Board is required to give notice both by public posting and to all owners of real property adjoining and adjacent to the subject property by mail.  The cost of this notice and posting is paid by the applicant and is one reason a fee is required for filing an application.

If the applicant is not the owner of the property, the owner shall stipulate to the Board, in writing, that the applicant is authorized to use the property as requested and described in the application and such stipulation/authorization shall be made a part of and shall accompany the application.

The Town of Collinsville and the Zoning Board of Adjustment wish to expedite the hearing process in the best and most effective manner.  The Board hears requests on a first-come, first-served basis and will do everything practical to process your application in a fair and timely manner.  Applicants will be notified by mail regarding the time and date of the public hearing.

Applications for Special Exception and Variance must also be accompanied by:

  1. A non-refundable fee of $25.00.

  2. A detailed explanation of the requested exception indicating the Section(s) of the Zoning Ordinance under which the Special Exception is requested.

  3. A site plan, drawn to scale, showing:  The location, use and dimensions of all existing and proposed structures; points of ingress and egress to the property; all public and private roads; off-street parking and loading; buffers; and signs.   An Application for Special Exception regarding a Mobile Home Park must be accompanied by a site plan and supplementary information as required in Article IV Section 4-1-4 of the Zoning Ordinance of the Town of Collinsville.

  4. A vicinity map showing location of the site in relation to the surrounding area and zoning of the subject site and surrounding property.

  5. A legal description and deed of the subject property.

  6. The names and addresses of all owners of adjoining and adjacent property.

  7. Any supplemental information which will assist the Board in reviewing the application.

Applicants are encouraged to review the Zoning Ordinance of the Town of Collinsville prior to submitting an application and to include a description of the manner by which applicable requirements will be met and/or how other satisfactory arrangement will be made regarding such requirements.

All information in your application will be provided to the Board before the actual meeting date.  It is to your benefit to explain as mush as possible about your position or proposal.
